Terms of Use

These Terms of Use (hereinafter "Terms") set forth the conditions for use of our service (including this website; hereinafter collectively referred to as the "Service"). These Terms apply to all users who use the Service.

Agreement to Terms

By using the Service, users are deemed to have given valid and irrevocable consent to these Terms. Users who do not agree to these Terms may not use the Service.

Use by Minors

If you are a minor, please use the Service only after obtaining the consent of your legal guardian. Any smartphone or other device required to use the Service must also be used with the consent of your legal guardian.

If a user who began using the Service without obtaining consent from a legal guardian reaches the age of majority, they shall be deemed to have ratified all acts of use during their minority.

Use of Content

We grant users a non-exclusive, non-transferable, non-sublicensable license to use, for private purposes within the scope of the Service, any text, images, videos, audio, music, software, programs, code, and other content provided by the Service. For paid content, such license is granted upon completion of payment of the fees we designate. Use of content beyond this scope is strictly prohibited.

Users agree in advance that, regardless of the reason, if they lose their right to use the Service, they will no longer be able to use any content of the Service.

Late Payment Fees

Any user who fails to make timely payment of monetary obligations to us shall pay late payment fees at the rate of 14.6% per annum.

Display of Advertisements

We may post advertisements of our own or third parties on the Service.

Prohibited Activities

Users must not engage in any of the following when using the Service:

  • Acts that violate laws, court judgments, decisions, orders, or legally binding administrative measures, or acts that facilitate such violations
  • Acts related to criminal activity
  • Acts that infringe on our intellectual property rights or those of third parties
  • Acts that infringe on our portrait rights, privacy, honor, or other rights or interests, or those of third parties
  • Acts that place excessive burden on our servers or networks or those of third parties, or that interfere with their normal operation
  • Acts that may interfere with the operation of our services
  • Unauthorized access or attempts thereof
  • Acts of analyzing the source code of the Service through disassembly, decompilation, reverse engineering, or similar methods
  • Unauthorized access to systems connected to the Service or unauthorized alteration or deletion of information stored in our equipment
  • Copying, transmitting, transferring, lending, or modifying our website or software
  • Lending, transferring, selling, or otherwise dealing in accounts or content on the Service for compensation to third parties
  • Commercial use of information obtained through the Service
  • Acts aimed at obtaining profit related to the Service through methods not intended by us
  • Advertising, soliciting, or conducting business on the Service without our permission
  • Collecting or accumulating personal information about other users
  • Using the Service for illegal, unauthorized, or improper purposes
  • Acts that cause disadvantage, harm, or discomfort to other users or third parties
  • Impersonating other users
  • Using another user's account
  • Acts aimed at meeting strangers of the opposite sex
  • Directly or indirectly providing benefits to antisocial forces
  • Acts contrary to public order and morals
  • Using the Service while walking, driving, or in other situations or manners where use of the Service is inappropriate
  • Any other acts we deem inappropriate

Prohibition of Cash Conversion

The following transactions are strictly prohibited for all content or virtual currency obtained within the Service, regardless of the means:

  • Buying and selling
  • Any transfer, assignment, lending, or borrowing involving the exchange of money or other consideration
  • Any other acts we determine to constitute cash conversion

Exclusion of Antisocial Forces

Users represent and warrant that they do not currently, and will not in the future, fall under any of the following categories:

  • Being, or having been within the past five years, a member of an organized crime group (boryokudan), a boryokudan member, a quasi-member of a boryokudan, a boryokudan-affiliated company, a corporate extortionist (sokaiya), a social movement racketeer, a special intelligence violent group, or any other entity equivalent thereto (collectively "Boryokudan Members")
  • If the user is a corporation or other organization, having a relationship in which Boryokudan Members are recognized as controlling its management
  • If the user is a corporation or other organization, having a relationship in which Boryokudan Members are recognized as being substantially involved in its management
  • Having a relationship recognized as utilizing Boryokudan Members, such as conducting transactions for the purpose of improperly benefiting oneself or a third party, or causing damage to a third party
  • Having a relationship recognized as being involved with Boryokudan Members by providing funds or benefits to them
  • If the user is a corporation or other organization, having a relationship in which an officer or person substantially involved in management has a socially condemnable relationship with Boryokudan Members

Users warrant that they will not, personally or through a third party, engage in any of the following acts:

  • Violent demands
  • Unreasonable demands that exceed legal liability
  • Threatening language or violence in connection with transactions
  • Spreading rumors, using fraudulent means, or using force to damage our reputation or obstruct our business
  • Any other acts equivalent to the foregoing

Restriction of Use

We may, without prior notice, restrict a user's use of all or part of the Service, or delete their user registration, if any of the following applies. We shall bear no responsibility for any damages incurred by users as a result of actions taken under this section.

  • Violation of any provision of these Terms
  • Discovery that registration information contains false facts
  • Failure to fulfill monetary obligations
  • Failure to respond to our communications within a reasonable period
  • No use of the Service for a substantial period from the date of last use
  • We determine that the user is or is involved with antisocial forces
  • Any other case where we determine use of the Service to be inappropriate

Suspension of Service

We may, without prior notice to users, suspend or interrupt all or part of the Service if we determine that any of the following circumstances exist. We shall bear no responsibility for any disadvantage or damage suffered by users or third parties in such cases.

  • When performing maintenance, inspection, or updates of the computer systems related to the Service
  • When provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fires, power outages, natural disasters, or virus outbreaks
  • When computers or communication lines are interrupted due to an accident
  • Any other case where we determine provision of the Service to be difficult

Disclaimer of Warranties

We do not warrant that the Service or the content provided by the Service is free from system bugs or infringement of third-party rights. We also do not warrant safety, reliability, accuracy, completeness, validity, or fitness for a particular purpose.

Limitation of Liability

We bear no responsibility for any damages incurred by users in connection with the Service. However, this disclaimer does not apply if the contract between us and the user regarding the Service (including these Terms) constitutes a consumer contract as defined by the Consumer Contract Act.

Even in the case of a consumer contract, we shall be liable only for damages directly and actually incurred by users due to our negligence (excluding gross negligence), and our liability shall be capped at the lower of one month's service fees or 10,000 yen.

Changes to Service Content

We may change the content of the Service, or discontinue or terminate the Service, without notifying users. Users agree in advance, without objection, that if the Service is terminated, they will lose all rights to use paid content and will no longer be able to use such paid content thereafter. We bear no responsibility for damages incurred by users as a result thereof.

Changes to Terms

We may change these Terms at any time without notifying users. The amended Terms shall take effect when posted on our website. Users who continue to use the Service after changes to these Terms shall be deemed to have agreed to the amended Terms.

Handling of Personal Information

Personal information obtained through use of the Service shall be handled appropriately in accordance with our Privacy Policy.

Notices and Communications

Notices and communications between users and us shall be made by methods designated by us. Unless a user notifies us of a change in accordance with our separately prescribed method, we shall treat the currently registered contact information as valid and send notices or communications thereto, which shall be deemed to have reached the user at the time of transmission.

Assignment of Rights and Obligations

Users may not assign, transfer, or pledge as collateral their position under the service agreement or any rights or obligations under these Terms to any third party without our prior written consent.

Business Transfer

If we transfer the business related to the Service to another company (including any case of business transfer, corporate split, or any other transfer of business), we may transfer the user's position under the service agreement, rights and obligations under these Terms, and user information to the transferee of such business transfer. Users shall be deemed to have consented to such transfer in advance.

Application

These Terms shall apply to all relationships between users and us regarding use of the Service.

In addition to these Terms, we may establish rules for use of the Service. Such rules, regardless of their name, shall constitute part of these Terms. In the event of a conflict between these Terms and such rules, the rules shall take precedence.

Severability

Even if any provision or part of these Terms is found to be invalid or unenforceable, such finding shall not affect the remaining provisions, which shall continue to be valid and enforceable.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan.

In the event of any dispute arising in connection with the Service, the district court having jurisdiction over our principal place of business shall have exclusive agreed jurisdiction.
